Payment of deposit and balance:
Payment terms: 50% deposit per person at the time of booking. Balance due 7 working days prior to commencement of arrangements. Payments (deposit & final balance) may be made by direct bank transfer to our Nairobi bank account (details will be included with our confirmation invoice) or by credit card.
Kids
From 2 years to 11 years are treated as children, They pay 75% of the adult price when sleeping alone and 50% when sleeping with the parent/guardian
From 12 years and above, they are treated as adults when it comes to payment
Cancellation Charges:
Our cancellation charges are determined by the fact that once we have booked with hotels and safari camps/lodges, they will charge us a cancellation fee if we cancel a booking.
In the unlikely event that the client has a complaint against the company, the Company must be informed immediately, in order that an opportunity is afforded to the company to investigate the situation and provide redress. If the client has any further complaints, these must be lodged in writing to the Company within 1 week of the tour end date. If these procedures are not followed, the Company will not start or continue any such investigation of said complaint.
Travel Insurance:
It is of importance that each Safari / Tour member in your party has adequate and comprehensive travel insurance covering cancellation or curtailment, as well as medical expenses, emergency travel, personal accident, personal baggage and money loss.
This should be arranged at the time of confirmation and deposit payment to cover you for cancellation from the time of booking. Please note that it is your responsibility to take out insurance, with the cost for your account, and that Natural World Kenya Safaris Ltd cannot be liable in any way whatsoever you should fail to do so.
If you are coming to East Africa from overseas, we request that you provide us with your insurance provider’s name, together with the policy number and the insurance company’s emergency contact telephone number in case of any emergency whilst you are traveling.
If you are suffering from any illness or disability, or are undergoing any medical treatment, you must declare this openly and honestly to Trek Mt Kenya Tours at the booking stage of your trip.
In a similar manner, if you are affected by any condition that may affect you or others during your trip in any way, you must comprehensively advise Trek Mt Kenya Tours at the time of your booking.
It is your responsibility to make arrangements for the provision of any medication or treatment while on tour.
Failing to declare any conditions, illnesses, disability or the like, will constitute a breach of these terms and conditions and can result in you being excluded from your booked trip or excursion without refund of any payment.
Changes and Alterations
The Company shall not be deemed to be in breach of these terms and conditions or otherwise be liable to the Client, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
If the Company is affected by Force Majeure it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the tour or safari.
No refunds are given for circumstances arising beyond the Company’s control, necessitating alternative arrangements being made to ensure the safety and/or further participation and enjoyment of the tour or safari.
In the unlikely event of a vehicle breakdown that is beyond the Company’s control and immediate repair, the Company will arrange to have the spare part sent to the current location in the fastest possible time. The Company reserves the right to alter the itinerary accordingly in order to make up any time lost due to any unforeseen circumstances.
The company reserves the right to cancel a tour without prior notification.
After your booking has been confirmed, should you wish to make any changes to your itinerary every effort to accommodate your requests will be made based on availability. However, there may extra costs involved to accommodate your request. These costs are in addition to the fee quoted to you for your initial safari. Normal cancellation fees apply if you wish to postpone your departure.
Trek Mt Kenya Tours does its best to ensure that all anticipated accommodation is available as planned, there shall be no claim of any nature whatsoever against Trek Mt Kenya Tours for a refund either in the whole or part, if any accommodation or excursion is unavailable and a reasonable alternative is  found. If the guest is unable to use any service provided in the itinerary, then there are no refunds due.
Transport:
It should be noted that the types of vehicles used for safari transport on rough roads in East Africa are different from tour vehicles on the highways in developed countries and normally they do not have air-conditioning other than the standard ventilation fan.
The Safari 4×4 Land Cruisers used throughout East Africa for overland road safaris on the main highways beyond the parks are of a standardized design with sliding passenger windows.
The Roads:
The roads between the parks may have rough stretches and the overland journeys can be lengthy as tour vehicles are limited to a maximum speed of 80 KM per hour.
Local flights between national parks / game reserves are an (extra) option when overland transfers are exceptionally long.
Law and Jurisdiction:
All terms and conditions of this agreement shall be governed by and construed in accordance to the laws of Kenya, and any litigation necessary to resolve disputes between the parties shall be held in the courts located in Kenya where such a dispute can be solved through arbitration.
